Yes. New York legalized adult-use recreational cannabis in March 2021 under the Marijuana Regulation and Taxation Act (MRTA). Adults 21 and older can legally purchase, possess, and consume cannabis. How much cannabis can I legally possess in New York?+
Adults 21 and older can possess up to three ounces (84 grams) of cannabis flower or up to 24 grams of concentrated cannabis (such as vape cartridges, wax, or shatter) for personal use. At home, you may store up to five pounds of cannabis. Possession within these limits is fully legal and cannot result in arrest or citation.
Where can I legally consume cannabis in New York?+
You can consume cannabis on private property where the property owner or landlord permits it. Some designated cannabis consumption lounges are also opening across the state. You cannot consume cannabis on public sidewalks, in public parks, on public transit, in workplaces, or inside bars and restaurants unless they hold a consumption lounge license. Essentially, the same rules that apply to smoking tobacco in public apply to smoking cannabis.
Can I drive after consuming cannabis?+
No. Driving under the influence of cannabis is illegal in New York, just as driving under the influence of alcohol is illegal. If you are transporting cannabis in a vehicle, keep it in a sealed, unopened container in a place not readily accessible to the driver or passengers, such as the trunk. Never consume cannabis before or while driving.
Can my employer still drug test me for cannabis?+
In most cases, yes. While New York law generally prohibits employers from discriminating against employees for legal off-duty cannabis use, there are exceptions. Employers in safety-sensitive industries, federal contractors, and positions covered by federal regulations such as DOT-regulated jobs can still test for cannabis. Some employers maintain drug-free workplace policies. It is best to review your employer's specific policy.
Can I travel with cannabis across state lines?+
No. Cannabis remains illegal at the federal level, and transporting it across state lines is a federal offense regardless of the laws in either state. Do not bring cannabis on flights, Amtrak trains, or across the George Washington Bridge, Lincoln Tunnel, or any other state boundary. Keep your cannabis within New York State.
What is the Office of Cannabis Management (OCM)?+
The OCM is the New York State agency responsible for regulating the cannabis industry. It issues licenses for cultivators, processors, distributors, and retailers.
